About these terms
These Terms of Use (“Terms”) are an agreement between you and LabSense (“LabSense”, “we”, “us”) about your use of the LabSense app for iOS and Android and this website (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
Our Privacy Policy explains how we handle your personal data, and How LabSense uses AI explains the AI features. Both are part of how the Service works, so please read them too.
Not medical advice
LabSense is for information only. It isn’t a medical device, doesn’t diagnose, treat or prevent any disease, and doesn’t replace a doctor. Always ask a qualified health professional about your results and before changing your treatment, diet or supplements. In an emergency, call your local emergency number straight away.
Reference ranges, statuses, scores, the Health Status, checkup suggestions, nutrient targets and Wiki articles are general information. They can’t take your full medical history into account, and they may contain mistakes. Read the Medical disclaimer for more.
The Service
LabSense helps you keep track of your health data: lab results and biomarkers with their reference and optimal ranges, a Health Status with body-system scores, checkup lists, food and supplement tracking, imports from Apple Health and Health Connect, and profiles for family members. Some features use AI, as described in How LabSense uses AI.
We keep improving LabSense, so features may change, be added or be removed. We’ll tell you in advance about changes that significantly reduce what you’ve paid for. We aim to keep LabSense available at all times, but we can’t promise it will always be available or free of errors.
Your account
- Age. You must be at least 18 to use LabSense.
- Signing in. You sign in with Google, with Apple (on iPhone and iPad) or with a code sent to your email. An account is identified by its email address. Keep access to your email and devices secure: anyone who can read your email can sign in to your account.
- Accurate information. Please give accurate information, such as the sex and year of birth on each profile, because reference ranges and suggestions depend on them.
- Profiles. An account can hold up to 6 profiles, each for an adult aged 18 or over. Only add someone else’s health data with their permission. You’re responsible for the profiles you add.
- Your responsibility. You’re responsible for what happens in your account. Tell us at support@labsenseapp.com if you think someone else has access to it.
Free and LabSense Plus
LabSense has a free plan and a paid subscription, LabSense Plus. Plus unlocks more features and removes the free plan’s limits, as described in the app. It covers every profile on your account, on iPhone and Android, when you’re signed in to the same account.
Free limits. The free plan includes a limited number of AI food logs and AI lab report uploads, a limited number of stored medical documents and a limited number of active supplements. The current limits are shown in the app. Uses made while you have Plus count toward the free limits too. Every account, Plus included, also has daily fair-use limits on AI features, set well above normal use, to protect the Service from misuse. We may change the free plan’s limits and which features are part of Plus; changes to paid features don’t affect a subscription period you’ve already paid for.
Buying Plus. Plus is sold through the App Store or Google Play, and your purchase is also subject to their terms. The price, in your currency, is shown in the app before you buy. Payment is charged to your App Store or Google Play account when you confirm the purchase.
Automatic renewal. Monthly and yearly plans renew automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Your store account is charged within the 24 hours before the period ends. If a price changes, the store tells you first, as its rules require.
Lifetime. A lifetime purchase is a one-time payment that unlocks Plus on your account for as long as we offer LabSense, with no renewal.
Free trials and offers. If an offer includes a free trial, it turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends.
Managing and cancelling. You manage and cancel your subscription in the store you bought it from:
- App Store: open Settings on your iPhone or iPad, tap your name, then Subscriptions.
- Google Play: open the Google Play app, tap your profile picture, then Payments & subscriptions → Subscriptions.
The app’s Manage subscription button takes you there too. Cancelling stops future renewals; Plus stays active until the end of the period you’ve paid for. Deleting your LabSense account doesn’t cancel your subscription, so cancel it in the store first.
Refunds. Refunds are handled by Apple or Google under their policies, and we can’t issue them ourselves. Request one at reportaproblem.apple.com or through Google Play. Nothing in these Terms limits any right to a refund or to withdraw from the purchase that you have under the law where you live.
Restoring purchases. If Plus doesn’t show up, for example on a new phone, tap Restore purchases in the app.
When Plus ends, nothing is deleted. Everything you added stays visible and editable, but you can’t add more than the free plan allows until you’re under its limits again.
AI features
Some features use AI provided by Anthropic and OpenAI, as explained in How LabSense uses AI. They only run after you allow AI processing in the app, and you can turn it off at any time.
AI output can be incomplete or wrong. It can misread a value, a unit or a date, estimate food incorrectly, or miss or overstate a health risk. Check digitized values against your original report, correct anything that’s wrong, and don’t rely on AI output alone for any health decision.
Your content
Your content is what you add to LabSense: results, files, photos, descriptions, answers and everything else. It stays yours.
You give us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process and transmit your content, including to the service providers named in our Privacy Policy, only as needed to provide the Service to you, to keep it secure and, for the problem reports you choose to send us, to improve it. This license ends when you delete the content or your account, except for copies kept for a short time in backups, as our Privacy Policy describes.
You confirm that you have the right to add your content, including any data about family members.
If you send us feedback or ideas, we may use them without any obligation to you.
Acceptable use
LabSense is for personal use by you and your family. You agree not to:
- break the law, or infringe anyone’s rights, while using the Service
- add someone else’s health data without their permission
- upload content that contains malware, or that’s illegal or abusive
- try to get around the free limits, the fair-use limits, the in-app purchase system or our security
- access the Service by automated means, such as bots or scrapers, or send it excessive requests
- try to access other people’s accounts or data, or our systems beyond what the app allows
- copy, modify, reverse engineer or resell the app or its content, except where the law allows it
- use the Service to provide medical services to others, for example as a clinic managing patients’ records
Our content
The LabSense app, its design, its biomarker and nutrient catalog, the Wiki and the rest of the Service belong to LabSense or its licensors. We give you a personal, non-transferable, non-exclusive license to use the app on devices you own or control, under these Terms and the store’s rules. Some parts of LabSense are open-source software under their own licenses; our redaction service, for example, is published under the GNU Affero General Public License.
Other services
Signing in with Google or Apple, buying through the App Store or Google Play, and syncing with Apple Health or Health Connect also involve those companies’ services, which have their own terms. We’re not responsible for them.
Ending your account
You can stop using LabSense at any time and delete your account in More → Delete account, or as described on Delete your account.
We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect other users or the Service. Unless the law or a security risk prevents it, we’ll tell you why and give you a chance to respond, and to save your data first. If we stop offering LabSense, we’ll give you reasonable notice so you can save your data.
Disclaimers
We provide LabSense with care, but, to the extent the law allows, we provide it “as is” and “as available”, without warranties of any kind, including that it’s accurate, complete, fit for a particular purpose or uninterrupted. If you’re a consumer, this doesn’t affect your statutory rights.
Limitation of liability
To the extent the law allows, LabSense isn’t liable for indirect or consequential losses, such as lost profits or data, or for losses caused by relying on the Service instead of professional medical advice. Our total liability to you for any claim related to the Service is limited to the amount you paid for LabSense Plus in the 12 months before the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or any other liability that can’t be limited by law.
Changes to these terms
We may update these Terms, for example when we add features or the law changes. We’ll update the date at the top, and if a change is significant, we’ll tell you in the app or by email before it takes effect. If you keep using LabSense after that, the new Terms apply. If you don’t agree, you can stop using LabSense and delete your account.
Governing law and disputes
These Terms are governed by the laws of the country where LabSense is established. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there.
If you have a problem, please contact us first at support@labsenseapp.com. Most issues can be solved that way.
If you got LabSense from the App Store
These Terms are between you and LabSense, not Apple. Apple isn’t responsible for the app or its content, has no obligation to provide maintenance or support for it, and, to the extent the law allows, has no other warranty obligation for it. If the app doesn’t conform to any applicable warranty, you can tell Apple, and Apple will refund the purchase price, if any. Apple isn’t responsible for any claims relating to the app, such as product liability, failure to meet legal requirements, or consumer protection claims, nor for investigating or defending a claim that the app infringes someone’s intellectual property. You confirm that you’re not located in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
General
If any part of these Terms can’t be enforced, the rest still applies. If we don’t enforce a right straight away, we haven’t waived it. You can’t transfer your rights under these Terms to someone else; we may transfer ours as part of a merger or acquisition, and we’ll tell you if that happens. These Terms, with the Privacy Policy, are the whole agreement between you and LabSense about the Service.
